These Terms of Service constitute a legally binding legal agreement and service document between you (the user) and Atelier Lumin. This agreement sets forth the rules, obligations, and rights governing your use of our website and services.

By accessing or using our website or app, you expressly obtain consent to be bound by this legal agreement.

This website is operated by Mnemonic Limited, trading as Atelier Lumin (“Atelier Lumin”, “we”, “us”, “our”). By visiting or purchasing from our store, you agree to be bound by these Terms of Service (“Terms”), which also serve as our user agreement and terms and conditions agreement (sometimes referred to as a conditions agreement), and any policies referenced here or available by hyperlink. If you do not agree, please do not use the site.

2) Online store terms

To use this website or app, you must meet the applicable age requirements in your jurisdiction. If you are a minor, you must have your legal guardian's permission to use our online services. You agree not to use our products for any unlawful purpose or to violate any applicable laws.

3) General conditions

We reserve the right to refuse service to anyone for any reason at any time. Content may be transferred unencrypted over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our written permission.

The information and features provided on this site are subject to continual evolution, as we regularly enhance our service and adapt to better address user needs.

Prices are subject to change without notice. We may modify or discontinue the Service (or any part) without notice, including to address security and operability issues, for security reasons, or to address ongoing abuse. Modifications may be implemented urgently to address security, prevent ongoing abuse, or for other critical reasons. We are not liable for any modification, price change, suspension, or discontinuance.

6) Products or services

Certain fine art print products or digital content may have limited quantities or availability and are subject to our Returns & Refunds Policy. We aim to display colours and details accurately but cannot guarantee your device’s display is accurate. We may limit sales to any person, region, or jurisdiction and may discontinue any product or digital content at any time.

7) Orders & billing information

We may refuse any order. All orders are subject to the payment terms outlined in these Terms of Service. We may limit or cancel quantities per person, household, or order. If you have any questions regarding orders or billing, please contact Atelier Lumin support. Provide current, complete, and accurate purchase and account information; promptly update details to enable successful transactions and delivery.

8) Payments & third-party processors

Payments may be processed through Shopify Payments and supported payment providers such as PayPal, Apple Pay, and Google Pay, a service provided by Google LLC. Your use of those services may be subject to their own terms and privacy policies. We do not store full payment card details. If a payment is reversed or flagged, we may pause fulfilment until resolved.

Accepted cards/wallets: Visa, Mastercard, Amex, Apple Pay, Google Pay (provided by Google LLC).

Payment processing is subject to applicable legal requirements.

9) Shipping, delivery & risk of loss

See our Shipping Policy for delivery options, estimated lead times, tracking and any regional restrictions.

Each art print artwork is made to order. Production and delivery times vary depending on your location, product type and fulfilment route. Any delivery times shown are estimates and are not guaranteed delivery dates.

Risk of loss passes upon delivery to the address provided. Customs duties, import taxes or local handling fees, where applicable, are the buyer's responsibility.

10) Optional tools & third-party links

We may provide access to third-party tools or links “as is” without warranties or endorsements. Use is at your own risk; review third-party terms and policies.

13) Downloadable software & open source

The service may offer downloadable software, which is provided under an end user license agreement. Users are granted a non-exclusive, royalty-free license to use such software solely for personal, non-commercial purposes in connection with the service. In some cases, software may be distributed under open-source licenses, which may include terms that override certain provisions of this service agreement. Users must comply with all applicable open-source license terms. Atelier Lumin is not liable for any damages or losses arising from the use of open-source software provided through the service.

14) User account management

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. The service may require users to update or verify their information to ensure account security. Atelier Lumin may suspend or terminate accounts if there is reasonable suspicion of unauthorised access or misuse. Users can manage their accounts through the website or mobile apps, and automated means may be used to detect and prevent unauthorised activity. It is the user’s responsibility to notify Atelier Lumin immediately of any suspected security breaches.

11) User comments & submissions

By submitting content such as reviews, photos, comments or suggestions, you grant us a non-exclusive, royalty-free licence to use, edit, publish and display that content in connection with our website, marketing and social channels.

We may monitor, edit or remove such content if we consider it unlawful, offensive, misleading, otherwise inappropriate, or if it constitutes illegal content or infringes intellectual property rights. Automated systems may be used to detect and moderate such content in accordance with our policies, including those relating to art print details and framing options.

12) Personal information

Your submission of personal information is governed by our Privacy Policy. Personal information may also be retained or disclosed for legal purposes as required by applicable law.

13) Errors, inaccuracies & omissions

From time to time there may be information on the site or Service that contains typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, shipping charges, availability). We reserve the right to correct and to change or update information or cancel orders if any information is inaccurate at any time without notice.

14) Prohibited uses

In addition to other prohibitions in the Terms, you are prohibited from using the site or its content for: any unlawful purpose; soliciting others to perform unlawful acts; engaging in illegal activities; violating laws or regulations; infringing our IP rights; harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating or discriminating; submitting false or misleading information; uploading viruses or malicious code; collecting or tracking personal information without consent; spamming, phishing, pharming, pretexting, spidering, crawling or scraping; any obscene or immoral purpose; or interfering with security features of the Service.
